These terms govern your use of LotKeeper. They are written to be read, not to be got past. By ticking the box on your account details, you agree to them on behalf of your dealership.
LotKeeper answers the customer enquiries your lead sources send you. You point a source — AutoTrader, Cars.com, your own website form — at an address we give you. When an enquiry arrives there we read it, write a reply in your dealership’s name and send it, usually within a minute. We answer up to three times per customer and then hand the conversation to you and stop.
We answer on your behalf. Replies go out under your name, to your customers, and are your dealership’s communications for every purpose.
LotKeeper is for business use by a motor dealership. It is not for consumers, and you must be authorised to enter into these terms for the dealership named on the account.
One dealership per account. You are responsible for what happens under your account, including keeping your sign-in link and password to yourself — anyone holding either can read your customers’ conversations.
New accounts start with a free trial. When it ends, replies stop until you choose a plan. Nothing is deleted and leads keep arriving — they simply stop being answered. Conversations already under way are finished, because leaving a customer mid-exchange is not a billing policy.
Plans are billed monthly in advance. You can cancel at any time and keep the service to the end of the period you have paid for. We do not refund part-months, and we do not pro-rate a cancellation made mid-period.
Fees exclude any taxes, which are yours where they apply.
You agree not to use LotKeeper to:
— contact people who have not enquired with your dealership; — send anything unlawful, deceptive, harassing or discriminatory; — misrepresent a vehicle, a price or your identity; — attempt to breach or test the security of the service; or — resell or provide the service to another dealership without our written agreement.
If an account is used this way, or in a way that puts our sending reputation at risk, we may suspend it. We will tell you why, in writing.
You decide who we write to: the contact details come from the leads your sources send us. You are responsible for having the legal right to contact those people by email and, where applicable, by text message. That includes compliance with the Telephone Consumer Protection Act (TCPA), the CAN-SPAM Act, and any state or other law that applies to you.
We provide the tools that help: every customer email carries your postal address and an unsubscribe instruction, a reply of STOP is honoured immediately and permanently, and text messages are held outside your local quiet hours. Those are tools, not consent — the consent is yours to have.
You will indemnify us against claims, penalties and reasonable legal costs arising from your lack of the right to contact a person we messaged for you, or from your breach of section 4.
Replies are generated by a language model working from the details you give us about your dealership, with automatic checks in front of them. Those checks refuse to quote or negotiate a price, refuse to confirm that a specific vehicle is still available, and refuse to book an appointment. They are good and they are not a person.
A reply may still contain a mistake. You are responsible for the offers, prices, availability and commitments your dealership makes, including anything said in a reply we sent for you. Read the conversations — they are all in your account — and tell us when something is wrong so we can fix the cause.
We work to keep LotKeeper running and answering quickly, and we do not promise it will never be unavailable. Maintenance, a provider outage or a fault can interrupt it.
We make no guarantee of results: not of sales, appointments, replies from customers, or any particular response time. The service is provided as it is, without warranties beyond those that cannot lawfully be excluded.
Neither party is liable for indirect or consequential loss, or for lost profits, revenue or goodwill.
Our total liability arising out of or relating to these terms is limited to the fees you paid us in the three months before the claim arose.
Nothing here limits liability for fraud, for death or personal injury caused by negligence, or for anything else that cannot lawfully be limited.
You can close your account at any time from the Account page, which deletes your dealership, your leads and your messages — see the Privacy Policy for exactly what goes. If the account has a billing history we close it by hand so any invoice or refund is settled first; write to us and we will do it.
We may end the agreement on 30 days’ written notice, or immediately if you breach these terms materially and do not fix it within 14 days of being asked.
We may change these terms. If a change matters to you, we will ask you to agree again the next time you sign in, and you will be able to read the document before you do. Continuing to use LotKeeper after agreeing is what makes the new version apply.
These terms are governed by the law of Poland, and the courts of Poland have exclusive jurisdiction over any dispute arising from them.
